These Terms of Use ("Terms") govern your access to and use of the Lone Star Equity website, operated by Rugged Ascend, LLC ("we," "us," or "our"). Please read them carefully. They include an arbitration provision and class-action waiver that affect how disputes are resolved.

01Acceptance of terms

By accessing or using this website, or by submitting information through it, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the site. We may update these Terms from time to time; the "Last updated" date reflects the most recent version, and your continued use constitutes acceptance of any changes.

02Website purpose

This website is an educational and lead-generation platform. Its purpose is to help you understand home equity concepts and to connect you, at your request, with participating licensed mortgage professionals who may be able to assist you. We are not a lender, mortgage broker, or mortgage loan originator, and we do not make lending decisions or issue mortgages. See our Disclosures for details.

The content on this site — including the equity estimator and any educational material — is provided for general informational purposes only. It is not financial, investment, accounting, or tax advice, and it does not account for your individual circumstances. Any figures shown are estimates, not offers. You should consult a qualified professional before making financial decisions.

04No legal advice

Nothing on this site is legal advice, and using the site does not create an attorney-client relationship. Statements about Texas home equity law and other legal matters are general summaries and may not reflect the most current law or your specific situation. Consult a licensed attorney for advice about your circumstances.

05No guarantee of loan approval

Submitting information through this site is not a loan application and does not guarantee that you will be approved for any loan or financing. All lending decisions are made solely by licensed lenders, in their discretion, subject to underwriting and applicable law. Not all applicants qualify.

06No guarantee of rates or terms

We do not set, offer, or guarantee any interest rate, fee, loan amount, or loan term. Any rate or term you may see referenced elsewhere is illustrative only. Actual rates and terms are determined by the lender based on your qualifications, the property, market conditions, and applicable law, and are subject to change.

07User responsibilities

You agree to:

• Provide accurate, current, and complete information;
• Submit only your own information, or information you are authorized to submit;
• Use the site only for lawful, personal, non-commercial purposes; and
• Be at least 18 years old and legally able to enter into these Terms.

08Prohibited uses

You may not:

• Submit false, misleading, or fraudulent information, or impersonate another person;
• Use the site to violate any law or the rights of others;
• Attempt to gain unauthorized access to the site, its systems, or its data;
• Introduce viruses, malware, or other harmful code;
• Use automated means (bots, scrapers, harvesters) to access or collect data from the site;
• Interfere with or disrupt the operation of the site; or
• Reproduce, resell, or exploit any part of the site without our written permission.

09Intellectual property

The site and its content — including text, design, graphics, logos, and code — are owned by Rugged Ascend, LLC or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the site for its intended purpose. All rights not expressly granted are reserved. You may not use our trademarks without prior written consent.

10Limitation of liability

To the fullest extent permitted by law, the site and its content are provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the site will be uninterrupted, error-free, or secure, or that any information is accurate or complete.

To the fullest extent permitted by law, Rugged Ascend, LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the site or your interactions with any lender or third party, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to the site will not exceed one hundred dollars (US $100). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

We are not responsible for the acts, omissions, products, services, or communications of any lender or third party to whom your information is provided. Any transaction you enter into with a lender is solely between you and that lender.

11Indemnification

You agree to indemnify, defend, and hold harmless Rugged Ascend, LLC and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the site, your violation of these Terms, your violation of any law, or your infringement of any third-party right.

12Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Subject to the arbitration provision below, you agree that any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction. As we expand into other states, additional state-specific terms may apply to residents of those states.

13Arbitration and class-action waiver

Please read this section carefully — it affects your legal rights.

Except for disputes that qualify for small-claims court or seek injunctive relief for intellectual-property matters, you and Rugged Ascend, LLC agree to resolve any dispute arising out of or relating to these Terms or your use of the site through binding individual arbitration, rather than in court. Arbitration will be administered by a recognized arbitration provider under its consumer arbitration rules, and judgment on the award may be entered in any court with jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this provision.

Class-action waiver. You and we agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.

Opt-out. You may opt out of this arbitration provision by sending written notice to us at the contact information below within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms.

14Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed or limited to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of it.
